The epic publishing rights might have been limited to the 1 year exclusivity period after which a new agreement might have had to be made between the two for Nacon to continue publishing it on Epic. It might have just been a simple publishing agreement(without funding) and as such, not something that can be forced by Nacon. The GOG version could have been a separate agreement that was inked later on but not yet put into effect. Specifics are hard to determine unless we see the contract itself.

The game was once listed as "Coming Soon" to GOG before the legal issues began. I also was able to get all the dlc locked outfits, but i think they are from a different dlc. So either something bugged out and i got lucky, or they settled their lawsuit. In the same run i did the dlc´s two other quests (fool´s gold and Defunct Brain Cylinders) It´s the achievement for the "silence is golden" quest, wich is part of the "mercyful madness" dlc. 2021 - so a little less than four months ago. I got the "All Sewn Up - Banish Granny Weaver" one on Dez. This is the version of the game that Nacon has the publishing rights to, which is not the version with the Merciful Madness DLC.
What is on Steam right now appears to be the same copy of the game that was available on Epic back when the game was an Epic Games Store exclusive. My understanding is Nacon was legally not allowed to sell that version so they later reverted the game back to any earlier version that they were allowed to sell.
